Supreme Court Sides With Democrats On Pennsylvania Mail-In Deadline After Justice Roberts Joins Liberals

In a decision that could have profound consequences for the outcome of the election, late on Monday the Supreme Court denied a request from Pennsylvania’s Republican Party to shorten the deadlines for mail-in ballots in the state after Chief Justice John Roberts joined liberal justices Sotomayor, Kagan and Breyer to oppose the four conservative justices Thomas, Alito, Kavanaugh and Gorsuch who said they would have granted the application.

After a Pennsylvania Supreme Court decision had moved the deadline for absentee ballots to be counted from 8 p.m. on Election Day to 5 p.m. the following Friday, Nov. 6, Pennsylvania Republicans and top officials from the state’s GOP-held legislature asked the Supreme Court to the ruling.

If the U.S. Supreme Court had granted a stay, it would have resulted in a return to the original deadline. However, due to the court’s 4-4 deadlock, the previous decision stays and mail-in ballots can be counted.

As reported earlier, when discussing the implications of timing when absentee ballots are pre-processed, some states do not allow mail-in ballots to be opened before Election Day which could mean counting delays. This includes a few of the critical swing states – such as PA and WI.

And as previously discussed, with a recent WSJ/NBC poll finding that 47% of Biden supporters plan to vote by mail whereas 86% of Trump supporters will vote in person, the ruling is seen as a win for Democrats in the key battleground state, which President Trump won in 2016 by just over 44,000 votes, since Biden voters are considered more likely than Trump supporters to vote by mail in November.

Finally, as Axios adds, the deadlock underscores the importance for Republicans of confirming Trump’s Supreme Court nominee Amy Coney Barrett, who the president himself has said could be a deciding vote in an election-related dispute, since it is by now clear that Roberts plans on siding with liberals on election-related matters.

A new photo of Hunter Biden’s business partner Devon Archer meeting with Vice President Joe Biden in his office in 2014 was released today.

The image and another from Joe Biden’s ceremonial office ran in a Russia Today broadcast in 2014.

The room in this photo which ran in the Russia Today segment appears to be the Vice President’s ceremonial office.

Documents released last week by The New York Post show that Vadym Pozharskyi, an adviser to the board of Burisma, allegedly sent Hunter Biden on April 17, 2015, about a year after Hunter joined the Burisma board at a reported salary of up to $50,000 a month.

The footage is from Russia Today back in 2014 when Russia went to war with Ukraine.

The attorneys for Rosemont Seneca Partners — Hunter Biden and Devon Archer’s company — later wrote Burisma and told them to remove the photo from their webpage!!

Devon Archer was convicted of misusing proceeds from a $60 million bond sale involving the Oglala Sioux Tribe.

U.S. Supreme court rejects Republican bid to limit mail-in voting in Pennsylvania

WASHINGTON (Reuters) – The U.S. Supreme Court on Monday allowed an extension of the deadline for mail-in absentee ballots in Pennsylvania for the Nov. 3 election, declining a Republican request to block a lower court’s ruling that gave voters more time.

The justices, divided 4-4, left in place a Pennsylvania Supreme Court ruling in favor of state Democrats that had extended the deadline for state election officials to receive mail-in ballots postmarked by the evening of Election Day until three days afterward.

The brief court order noted that four of the court’s five conservative justices would have granted the request. There are currently only eight justices on the usually nine-member court because of the death last month of liberal Justice Ruth Bader Ginsburg, which left the court with a 5-3 conservative majority.

Chief Justice John Roberts joined the three liberal justices in denying the request, with five votes needed for it to be granted.

The state Republican Party and Republican officials in Pennsylvania separately appealed the state Supreme Court ruling as they sought to tighten deadlines for mail-in ballots.

Pennsylvania is an election battleground state as President Donald Trump seeks a second term in office. Trump won Pennsylvania in 2016 but is trailing Democratic opponent Joe Biden in opinion polls this year.

In a Sept. 17 ruling, the state high court ruled in favor of the Pennsylvania Democratic Party and various Democratic officials and candidates who had asked for the court to protect voting rights during the coronavirus pandemic, which has prompted an increase in requests for mail-in ballots.

The Democrats also raised concerns about whether the U.S. Postal Service, led by a Trump ally, would be able to handle the surge of ballots in a timely manner.

Democrat Kathy Boockvar, the Pennsylvania secretary of state, backed a three-day extension.
